Family Mediation, more than any other method of resolving family law disputes, gives the parties an opportunity to actually talk to each other and share their concerns about various issues arising out of their separation, whether related to their children, to support or to property issues. The role of the mediator in a Family Mediation is to moderate that dialogue between the parties, to ensure that the discussion is topical, balanced, organized, and that each party has an opportunity to express their views without being overpowered by the other. Family Court in Ontario gives separated parties some opportunity to engage in such a dialogue, in the presence of a judge in the context of case management (Conferences) but as compared to the possibility of dialogue in Family Mediation, such opportunities within the court system are very limited.
